1. Who you are dealing with

Omyis (“we”) provides research software. You can reach us at support@omyis.com. Omyis is the trading name of a company incorporated in Ontario, Canada, Ontario corporation number 1001103239.

2. The service

Our products are browser-based software for research and engineering work. Omyis Vasculartoolkit, which prepares vascular models for simulation, is the first; these terms apply in the same way to any product we release afterwards. The free plan can be used without an account; Pro requires one. We may change, add or remove features; where a change materially reduces what a paid plan provides, we will tell subscribers in advance.

3. Accounts

You are responsible for what happens under your account and for keeping your credentials safe. Accounts are for one person and are not to be shared. You must confirm your email address before you can sign in.

4. Your data and your models

Whatever you upload — models, images, measurements or other data — remains yours. We claim no ownership of it and do not use it to train anything. In Omyis Vasculartoolkit your uploads are processed in memory for the duration of your session and are not written to shared storage; where a future product works differently, its own documentation will say so plainly. Do not upload data you are not permitted to process, and remove patient identifiers first: our products are not designed to hold identifiable personal health information.

5. Not medical devices, and not clinical advice

Our products are software for research and engineering work. Unless we state otherwise in writing for a specific product, no Omyis product is a medical device: none is cleared, certified or registered as one with any regulator, and none is intended to diagnose, treat, cure, prevent or monitor any disease or condition in any identified patient.

Output from our products — geometry, meshes, simulation cases, measurements, images or derived numbers of any kind — is an engineering result, not a clinical finding. It must not be relied on to make a decision about a person’s care, and a qualified clinician remains responsible for every clinical judgement. You are responsible for validating any result before it informs published research, a regulatory submission or a device design.

This clause applies to every product we offer now or in the future. If we ever obtain regulatory clearance for a product, we will say so explicitly in that product’s documentation and state which approvals it holds and where they apply; only then, and only for that product, does this clause not apply.

6. Plans and payment

Free plans are offered as they stand. Paid plans are billed in advance, monthly or yearly, at the prices shown for that product on this site. Prices may change with notice; a change never applies to a period already paid for. Refunds and cancellation are covered by our refund policy. Paid plans are sold through Paddle, which acts as the merchant of record for the purchase: Paddle is the seller, collects the payment, charges any sales tax or VAT that applies where you are, and issues the receipt. Paddle’s own terms apply to the transaction alongside these.

7. Acceptable use

Do not attempt to break, overload or circumvent the limits of the service, do not resell access, and do not use it to store or distribute unlawful material. We may suspend an account that does.

8. Availability

We aim to keep the service running but do not promise it will be uninterrupted. There is no service level agreement on any plan described on this site. Planned maintenance will be announced where practical.

9. Liability

To the extent the law permits, our total liability arising from the service is limited to what you paid us in the twelve months before the claim, and we are not liable for lost profits, lost data, or indirect loss. Nothing here limits liability that cannot be limited by law.

10. Ending the agreement

You may stop using the service at any time and cancel a subscription as described in the refund policy. We may end an account for a serious or repeated breach of these terms, with notice where circumstances allow.

11. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have exclusive jurisdiction over any dispute arising from them.

Cancelling

You can cancel a subscription at any time from your account. Cancellation stops the next payment; your Pro access continues until the end of the period you have already paid for, and then reverts to the free plan. Your models and account stay in place.

Refunds

If an Omyis product is not what you expected, write to support@omyis.com within 14 days of a payment and we will refund it in full, without asking you to justify the request. This applies to a first subscription and to a yearly renewal.

Monthly renewals

For a monthly renewal after the first payment, we refund when the service did not work as described, or when you clearly did not use it in that period. Cancel before the renewal date to avoid the charge entirely.

If something is broken

If a fault stopped you working, tell us what happened. We would rather fix it and extend your subscription by the lost time, but you may have a refund instead.

How refunds are paid

Refunds go back to the original payment method, normally within five to ten working days depending on your bank. The free plan involves no payment and so nothing to refund.

What we collect

Your account: the email address you sign up with, and the name and company you give us when asked. That is what identifies you to the service.

The models you upload: held in memory for the length of your session in order to do the work you asked for, then discarded. They are not written to shared storage, not used to train anything, and not shared.

Operational records: server logs of each request to this website and the application: the IP address, the time, the page requested and the browser’s description of itself. We keep them so we can keep the service running and secure, and we count visits from them, using the IP address to estimate the country and city a visit comes from. That estimate is made on our own server; no address is sent to anyone else for it.

We do not run advertising or analytics trackers on this website: no tracking code runs in your browser, and the visit counts come only from our own server logs.

Why we are allowed to hold it

We hold account data to provide a service you asked for, and operational records because we have a legitimate interest in the service working and being secure, and in knowing how much it is used and from where.

Who else processes it

A small number of suppliers help us run the service: an identity provider for sign-in and account credentials, an email provider that delivers messages such as your confirmation email, and a hosting provider for this website and the application. A payment provider will join that list when paid plans open, and will hold the billing details for any purchase.

Each acts only on our instructions and may use your data solely to provide that service to us. We share your data with no one else, and we do not sell it. Between them, these suppliers hold data in Canada, the United States and Germany, so your account data is processed outside Canada as well as in it, in countries whose authorities may have lawful access to it.

We will name our current suppliers on request — write to support@omyis.com, and procurement teams are welcome to ask before signing anything.

Health data

Do not upload identifiable patient data. The service is built for de-identified models, we ask you not to send us personal health information, and it is not designed or certified to hold it.

How long we keep things

Account data for as long as you have an account, and for a short period afterwards in our backups. Uploaded models only for the session. Server logs for 180 days, after which they are deleted automatically.

Your choices

Write to support@omyis.com to get a copy of what we hold about you, to correct it, or to have your account and its data deleted. Deletion is permanent, and we will confirm when it is done.

Cookies

The application sets one cookie that keeps you signed in. It is necessary for the service to function, and there are no advertising or tracking cookies on this site.
